Medical malpractice or bad outcome?
Medical malpractice occurs when a doctor, nurse, pharmacist, hospital, HMO (health maintenance organization, or other medical professional fails to perform their professional obligations, resulting in death or serious injury. This includes failure to diagnose an illness in a timely professional manner, surgical mistakes, mistakes in the delivery of a child, mistakes with medications, or causing any loss or injury by not performing professionally.

Just because a medical procedure may have a bad outcome, it doesn't necessarily mean that it is medical malpractice. Medical malpractice is an extremely serious act. Malpractice can be ignorance, negligence or improper use of method and practice. The result of malpractice is injury and/or loss to the patient.

There is typically a statute of limitations, or number of years, after which you may not be able to pursue legal action. Several elements must be present in a case of medical malpractice: the patient must be worse after the procedure, most other medical professionals would not treated the patient in that manner, and it must be shown that the treatment is what made the patient worse.
